Bad Company) feedback. There should be some amends for the
criminally neglectful actions of the "American Baptist Homes Of The
West" in charge of a proper level of supportive housing care for the
disabled and for persons with HIV. This company is unduly
targeting members our community, case by case, into the streets of HIV
homelessness which is sending our community one tenant at a time to
death.
Would anyone have the resources to research
the mere ratio and volume of eviction cases from Allen Temple Manor (HUD
Section 811) and compare it to other similar HIV Supportive care
housing with supposed HUD oversight.
Does anyone want to find the duty to make amends for what has occurred?
Class
Action Lawsuit may just be the only means to stop what is the "GOD
HATES FAGGOTS WITH AIDS!" Baptist Church mentality in this housing
facility that apparently is their working agenda to justify their
knowingly falsified court filings in their eviction cases.
Do
they offer any reasonable defense from this statement now publicly made
here? Let's take it to before a magistrate of a judicial court.

building manager at the time, Mr Jamal Graham is no longer employed and
what has been told to me the reasons for his termination is due to
suspicion and/or actual criminal charges of EMBEZZLEMENT. Also
involved in TELEPHONE WIRING TAPPING with one other tenant [FEDERAL
CRIMES]. This is one of the reasons why I am re-directing
this final telecom billing on this account in this manner.
During
my case, I actually had to contact the Office of the FBI both via email
for cyber-related stocking crimes and then in PERSON at the FBI office
in Oakland CA on June 21 2006.

FACT!
All of these above occurrences are by intently and vigorous acts by
persons of managerial and authoritative capabilities of influence in the
HIV/AIDS supportive social services of the LOCAL HIV COMMUNITY OAKLAND
CA USA. In the defendant's attempt to better his life and to establish a
proper level of provider supportive care services that these services
were being intently obscured by not being delivered and/or were being
mis-directed by referrals of services that the defendant had criteria
that the defendant did not qualify for these referred services. This
situation had been in continuous dysfunction for more than 18 months.
As
just a preliminary snapshot of a single point of time reference, note
the comparison and depiction of emails from the defendant. The cause of
the actual true depiction of "exorbitant" is addressed as "there are no
policy pathways present" to air any voice of concerns. This is an
intolerable and asinine condition pressing against the common sense
realities of the world.
During
my homeless period, I have had my Oakland Storage Unit Burglarized and
theft property stolen in October 2006. And in January 2007 --- in
the time period that I was self-documenting my defense side of this case

] my vehicle was stolen from this service address in San
Bernardino and left at the former address of my brother as some sort
of terrorist scare tactic message to me to cease my
activities --- which has FAMILITY THREATS IMPLIED. Both of these

case that targets certain fault factors in HIV supportive care services.

Speyer as my long time established HIV supportive case management at
"The Center for Aids Services, Oakland CA" which is a labeling name of
"community association" which this target identity no longer is named.
It is known as "Vital Life Services" thus stripping the concept of
community support labeling identity.
Mr.
Graham as the administrator of HIV supportive care housing as well as
having the direct "personal history" between myself of HIV CASE
MANAGEMENT at Aids Project East Bay.
And I now ask of you --- where is the public discourse to why am I once again homeless?
I demand a public view apology.
You are murderous in these acts against the humanity element of it all in the LOCAL HIV COMMUNITY OAKLAND CA.
I CAN PROVE IT!
This is the time for all good men and women to come to the aid of the humanity in this case.

The deceptive, false, and perjured statements filed in court from the plaintiff's side are 100% completely untrue.
Even
more to the point, plaintiff's attorney knew that the defendant had
mentioned face to face on the court date of May 19th 2006 of the reason
of "legal civil necessity" was going to be argued by him. That the
defendant specifically stated to plaintiff's attorney that he would not /
would have never have acted at the state of criminal legal necessity in
this case.
Therefore the plaintiff's attorney should be held directly liable for these perjured statements ---being fully known and fully aware that the statements being filed to the court were false.
And
all I am demanding at this point is actionable community level address
for an apology to be remanded down into the public view before the
expiration date of February 1st 2007. After that --- I will be seeking
civil justice and criminal investigations for the actions of all
involved parties.
By your

your allegiance to which side of humanity you are actually engaged to

Horwitz and what was at that time my current legal assistance Sara Paul
Malan from the Aids Legal Referral Panel. The top most and last issued
portion of this change went to my current case management agency, "The
Center Oakland" before it was renamed to "Vital Life Services".
The
result of my attempting to find a "community level exchange" of "policy
pathways" is a messed up road of Betrayal and Persecution that even
apparently continues up into January 2007 here in San Bernardino in an
strange occurrence of my car being stolen and placed at the former
street residence of my brother.

In the Unlawful Unlawful Detainer Eviction Case, WG06266106, plaintiff has intently filed under penalty and perjury statements against defendant relating to defendant's emailing activities.

First
most, bringing forth any defense are just two sited authoritative
sources here for consideration that places the defendant's acts justifiably right.
The specific cited statements from these sources that the defendant
was acting from a foundation of expressions to be understood are

When individuals, families and communities openly acknowledge that HIV/AIDS is a matter that concerns them, they act to prevent its effects, and mobilise in their environment the support they need to maintain the quality of their lives.
The AIDS Competence Process (ACP)
ACP includes an ideal, an approach, a set of tools and is built on a common belief.
The ideal we believe in is AIDS Competence.
The approach we apply is Human Capacity Development. This means we build on people's strengths to create a social transformation. We see people as the subjects of their own development rather than as the objects of institutional intervention. We appreciate and reveal local capacity to tackle a local problem.
The tools we use are rooted in Knowledge Management. These consist of various tools including Self-Assessment, Peer Assist, and the development of Knowledge Assets.
The common belief that individuals and communities have the skills and the knowledge to improve their situation tie together AIDS Competence, Human Capacity Development and Knowledge Management in the AIDS Competence Process.

Prejudice remains an important obstacle to the social integration of persons with disabilities. Equality of opportunity is dependent on the recognition of the right to diversity, the "right to be different", a right that still remains elusive for many, but is the basis of a real change in society. Attitudes which take the form of indifference, of ignorance, of fear or hostility can have a very negative impact on quality of life and represent one of the largest obstacles to the recognition and the respect of rights of people with disabilities. Moreover, those who are members of ethnic [Black/African American Populations in Oakland] or visible minorities, or women with disabilities, often find themselves in situations of double or triple disadvantage.
The emergence of a movement to promote the human rights of persons with disabilities is about fifty years old. It stems from consumer organisations or advocacy groups who understood that true change required a change of model, from that of providing charity to providing self-help.

Today, in spite of these developments, people with disabilities remain largely marginalized. For many, their fundamental rights are still fragile, and access to true personal self-actualisation remains

People with disabilities also want to be a part of the information society. They will contribute to its development, bringing into play their knowledge and expertise. However, to do this, concrete measures must be put in place to resolve current difficulties and intervene with reference to emerging obstacles. Because, if this is not done, persons with disabilities will have little opportunity to participate in the information society.

Why is the last day always the most optimized.
Well... As I left the bus --- with a plate of Thanksgiving Fixin's in my hand... I signed to the Bus Driver...
I hear fine I speak fine and Thank you.
Obviously... I communicate fine too... what is wrong with all you people?
Here it is 2005.
I get on the bus. With this plate of fixin's in my hand. She wanted to take my transfer. I of course cannot speak. She said that she signs. And then... half-haphazardly I sign.... I need it. She understood... that was purely without forethought. I do not have practiced sign language skills for quite some time.
After a few moments... after I can adjust myself -- I don't want to spill my plate all over the place.... I walk up to the 82 L bus driver and show her my hand printed sign that says.
"I AM A HUMAN WITHOUT A TONGUE. IN HONOR OF MARLON T. RIGGS TONGUES UNTIED."
and signed to her:
"YOU ARE ONE OF THE GOOD DRIVERS. THERE ARE SO MANY BAD DRIVERS."
and she giggled.
THEN... I SIGNED BACK.
"THANK YOU THANK YOU THANK YOU"
3 times. And sat down.
Then.... as we were approaching the address 5725 I showed her my licence. And she actually stopped there. Of course she was not sure what I wanted. All I was trying to say with a plate of fixin's in my hand was that I was ONCE homeless. And that is the homeless shelter that I was at. And that I have thanks for not being homeless now.
Seminary is the next stop. It just so happens that the passenger in the upper right seat got off at that stop. So.... I sat down so that I could actually carry on a conversation with two hands. Then signed to her exactly what I needed. "That is a homeless shelter. [ s h e l t e r] for I don't know the sign for it. Then.... said I give "Thanks" 3 times.... and opened my plate of fixin's so that she actually saw that it was
THANKSGIVING.
And that is my story.....
Did you know that I won two raffle prizes. There was only 5 of us that received a second prize.
I got a $25.00 Safeway food voucher on the first draw.
And then the guy that was sitting to my left got movie theatre tickets.
For which he remarked som---ing "I am not going to use it" and was somehow disappointed.
Dr. Wilson was standing right there and commented to him that "he was rude".
He took his Pumpkin pie that he was eating and said "He doesn't even want this!!!" and then also make a comment that he was just speaking to himself.
For which then, I displayed to him my sign "I AM A HUMAN WITHOUT A TONGUE...."
Then, I personally wrote to him on the reverse side "Don't Hate ok?"
Everyone got a raffle prize and there was 5 prizes left.
I got into the 2nd drawing. It was a $15.00 gift certificate at the "OUT OF THE CLOSET" second hand store in two different notes $10.00 and $5.00
I took the $5.00 and shared it with him......
I hope that he took my gesture in good faith.... that he should actually apologize to Dr. Wilson for his attitude.

It is Christmas Eve 2006 as I write to the world in this multiply.com journal....
Defendant's acts of civil level necessity applies to being the only reasonable documented alternative of remedy ....
The cry for justice remainsunanswered and the public good has not been served.
Defendant's
right to prepare and/or offer any defense much less a fair defense for
his actions were intently violated by a myriad of factors, all of which
are associated to plaintiff and/or plaintiff's representative agents.
In criminal law, necessity may be either a possible excuse or an exculpation for breaking the law. Defendants seeking to rely on this defense argue that they should not be held liable for their actions as a crime because their conduct was necessary
to prevent some greater harm. For example, a drunk driver might contend
that he drove his car to get away from an armed robber. Most common law and civil lawjurisdictions
recognize this defense, but only under limited circumstances.
Generally, the defendant must affirmatively show (i.e., introduce some
evidence) that (a) the harm he sought to avoid outweighs the danger of
the prohibited conduct he is charged with; (b) he had no reasonable
alternative; (c) he ceased to engage in the prohibited conduct as soon
as the danger passed; and(d) he did not himself create the danger he
sought to avoid. Thus, with the "drunk driver" example cited above, the
necessity defense will not be recognized if the defendant drove further
than was reasonably necessary to get away from the robber, or if some
other reasonable alternative was available to him.

The civil acts of necessity of the defendant's actions are not at anywhere near a criminal level of action, but justifiably speaking. a criminal act would have been the more appropriate response
to then have been given a chance of due process rights, and to have
been given a chance for justice, to have received a fair case of
presenting a civil level defense to the court.
Of
course, a criminal level defense would have been appointed free legal
representation by the court whereas a civil level defense does not. This
is the conclusion of the defendant in this case currently now on this
Christmas Evening 2006 considering all of the future events that were
not yet known to be set against Defendant when his act of civil level
necessity was placed on February 26th 2006.
The
defendant's acts would be as a person living with HIV/AIDS attempting
to resolve, in addition to bringing priority, to his unanswered,
ignored, silenced, and oppressed requests of a proper level of PROVIDER
ASSISTANCE IN HIV SUPPORTIVE CARE SERVICES.
Legal justice in this case remains unanswered and public good remains unserved.
If
this case and it's remedies are not sought for appropriate corrective
action by other persons of managerial and authoritative capabilities
that are involved... further acts of necessity may be forced to be
engaged or required, not just of this case defendant but of other
parties that are still being effected by the long standing circumstances
involved in this case.
The justification is an intended thought to action of legal necessity by the defendant:
The
act of legal civil necessity was made immediately after several
conversations and consults with a defendant's friend. This friend would
later agree to come forward as a witness in this case. But at the time
of the this necessity act that was eventually decided by defendant as
the only alternative course to follow, Defendant Driskill specifically
tells his friend....
"Nobody
is listening to me. You may think I am crazy, but I am not. I know what
I am doing. I acknowledge and accept the consequences. Trust me
[friend] I really know what I need to do."
This dialog between defendant Driskill and friend occurred on Saturday February 25th.
This
conversation and promises made of Defendant Driskill to his friend
relates to his commitment and mission to receive a proper level of
PROVIDER ASSISTANCE IN HIV SUPPORTIVE CARE SERVICES and "quality of
life" that he deserves.
Ms
Nunes never opted to provide any direct face to face mediation or
workable solutions for this conflicted matter between Mr. Graham and
Defendant. [DOCUMENTED!]
The
defendant's statements made to his friend on Saturday February 25th
were after defendant received the e-mail below canceling a pre-scheduled
meeting between Defendant and Ms Jan Nunes of ABHOW [American Baptist
Homes of the West] for that following Monday to discuss issues over
repeated requests initated by the Defendant to resolve issues.
There are three key outgoing correspondences made before court date on May 19th 2006 and made after this date that mentions these failures.
1) On
April 10th 2006, an email and supplemental faxes of a key
correspondence from defendant was outgoing directed to three key target
places about the related issues.

The defendant writes about the circumstances of this meeting between
defendant and Ms Jan Nunes as a matter of issues directed "City Aids
Americas", "The Office Of The Mayor of Oakland", and the plantiff's

acting within and from the defendants resolve and to the platform of the

defendant specifcally stated to plaintiff's attorney that he would not /
would have never have acted at the state of criminal legal neccessity
in this case.

Defendant's last exchanges with Ms Nunes to have this pre-scheduled
meeting, Defendant Driskill mentioned the desire and intent to have an
appropriate 2006 business level standard technical aid tool of utilizing
a computer.
In
the days just prior to receiving the cancellation email above,
defendant's last phone call discussion with Ms Nunes relates to
resolving these issues specifically: [DOCUMENTED!]
Driskill : You know I want to use a computer. I am even willing to bring my own.
Nunes : You want to use a computer?
Driskill : Yes, of course.
[ END OF CALL ] : No further telephone discussions between Allen
Temple Agents and my self have occurred since this phone call. No email
from Ms Nunes has been received following the cancellation on Feb 24 2006.
The notation of Ms Nunes' statement "I can be available by phone later in the day" reinforces the absence of proper level response and continues to attempt to communicate with defendant as VERBAL ONLY.

The issue of verbal only discourse was previously attempted to be resolved by defendant:
On
December 28th 2005, in a legal state of duress defendant called ABHOW's
toll free number and spoke to Ms Nunes moments after a failed business
meeting between Defendant and building manager Mr. Graham. This
conversation should be documented as lasting for over an hour from phone
records.
A
handwritten letter to Jamal was at defendant's issues of discourse.
Prior to this meeting at 1pm, this letter had been written that morning,
pre-scanned and was attached to an email to Mr. Graham's office. The
actual letter was never personally delivered in real life to Mr. Graham
as it was also intended. This is directly due to the attitude and
intimidation continuing to be present from Mr. Graham onto defendant
that resulted in the failure of this business reevaluation meeting with
Mr. Graham and defendant.
Defendant
immediately proceeded in a very agitated state of duress to telephone
Ms Nunes. In that conversation, as mentioned, lasted more than an hour,
the handwritten letter to Jamal was verbally read to Ms Nunes.
"As
an engagement forced labeled "intimidation" shall my intrust of proper
exchange be broken. Today, and all of what was said on your voicemail
last night shall not be treated as words as temporary as toilet water. I
have no continuing matter that is more important with you individually
or as administrator. More important, return of that importance or lack
of it defines our fate."

Mr Graham: It would be safe to say that "I am talking about you" right
here. So what are you exactly going to do about it? Perhaps you should
think about "correcting the record" of the statements and lies that you
have filed in court. ONLY THEN will I consider removing these details of

of February 26 2006 11:58:17 AM by directing a facsimile to the manger
Jamal Graham. Contained in this outgoing facsimile in part, if not taken

defendant's life sphere of conditions. The defendant's needs, by this
time would be over a year, attempting to have a voice and resolve to his
continuing address to receive a a proper level of PROVIDER ASSISTANCE IN HIV SUPPORTIVE CARE SERVICES.
2) Defendant's
directed this fax to his direct HIV/AIDS services case manager, Ms. Ann
Speyer of the Center for Aids Services [thecenteroakland.org] now known
as Vital Life Services [vitalcalifornia.org] in Oakland CA.
3) The
defendant also directed this fax to his HIV medical care office, AHF
[Aids Healthcare Foundation] Oakland aka The Magic Johnson Clinic,
specifically attention to his medical care doctor, Doctor Wilson.
The
purpose of these faxes [ that included the mentioned act of necessity ]
was attempting to resolve a very much drastic need to get someone's
attention to his continuing address to receive a proper level of PROVIDER ASSISTANCE IN HIV SUPPORTIVE CARE SERVICES.
In
all that he attempted to bring to attention, both stated in face to
face as well as within these outbound reaching e-mails and facsimiles
were issues involved that he stated were of "LIFE AND DEATH" and "LIFE
AND WELLNESS" issues.
Not
a single person of managerial and/or authoritative capabilities
involved returned any interest in any way to return any efforts what so
ever to resolve the issues. These are of issues being directly and
indirectly experienced in the defendant's life both as living resident
wide at Allen Temple Manor and community wide in the LOCAL HIV COMMUNITY
OAKLAND CA USA.
There
are several key attempts of defendant Driskill to attempt to
intercommunicate these matters --- all of which were ignored,
roadblocked, and silenced.
As
evidenced in the fax transmittal log [as posted on this site] why a
final desperate act of necessity is the only mechanism that could or
would change any ACTIONABLE focus to effect any change for to the side
of better the life wellness needs of the defendant and fully onto his
entire community as a whole.
The mental state of defendant was adversely effected from not receiving any supportive returns from his continuing requests for receive a proper level of PROVIDER ASSISTANCE IN HIV SUPPORTIVE CARE SERVICES as well as a presence of secondary factors of harassment and persecution that was being received from inside community and outside community sources.
This is where mental abuse toward the defendant Driskill starts to be defined in this case.
But
as can be stated in a simple less insinuative statement, defendant's
"Quality of Life" from the lack of supportive return of self-supportive
issues not being able to be addressed in defendant's total sphere of the
"hierachy of human needs" at and/or below the chart level of "basic
needs" in the following areas:
These
negative factors being experienced were identified to be encapsulated
around defendant and defendant's peers. This encapsulation denies
defendant's "basic human needs" and the opportnities to
self-actualization that was once present and active in defendant's level
of his "quality of life" prior to becoming a person with HIV/AIDS and a
person of disability with HIV/AIDS in 2001.
The
experiencing level of his "Quality of Life" was directly and negatively
effected by the lack of support offered at every direction defendant
Driskill reached out to:
In
addition, in 1993, the UN General Assembly adopted the "Standard Rules
on Equalisation of Opportunities for Persons with Disabilities" [16]. These Rules do not have the force of law, but they were adopted in the spirit that they could represent a moral and political suasion for governments to apply them, in order to respect an international standard. [17]
Today, in spite of these developments, people with disabilities remain largely marginalized. For many, their fundamental rights are still fragile, and access to true personalself-actualisation remains beyond their means."
What
did happen can only be what was the better choice, even now present,
over what could have or would have occurred if the conditions in
Defendant's life remained at the same state including the presence of these secondary factors of harassment and persecution.
The
cause and effect then also starts to include his direct associated
circle of friends whom apparently were also distancing themselves from
defendant Driskill's affected mental state from these "mentally abusive" factors that was encapsulating his life.
In September 2005, defendant Driskill identifies and labels the effect of these circumstances as " HOMOSEXUAL SAVAGERY 2005 "
In
Thanksgiving 2005, Defendant Driskill attempts to be able to dialog
with Dr Robert C Scott, founder of Allen Temple Manor at the resident's
Thanksgiving Dinner held in the recreation room on Sat November 19th
2005. Defendant Driskill states to Dr Scott the same issues of "Life and wellness" of our community.

Driskill associates and identifies his efforts in attempting to obtain a

license accompanied with Dr Robert C. Scott's business card.

Note the closeness of the date related to efforts in attempting to
obtain a meeting with Doctor Robert C. Scott on November 19th 2005 and
the creation/posting of the titled "ClientCenteredHIV" images posted on
November 21, 2005.
Love
is not an easy feeling to put into words. Nor is loyalty, or trust, or
joy. But he was all of these. He loved life completely and he lived it
intensely.
A
few years back, Robert Kennedy wrote some words about his own father
which expresses [sic] the way we in his family felt about him. He said
of what his father meant to him, and I quote: "What it really all adds
up to is love -- not love as it is described with such facility in
popular magazines, but the kind of love that is affection and respect,
order and encouragement, and support. Our awareness of this was an
incalculable source of strength, and because real love is som---ing
unselfish and involves sacrifice and giving, we could not help but
profit from it."
And
he continued, "Beneath it all, he has tried to engender a social
conscience. There were wrongs which needed attention. There were people
who were poor and needed help. And we have a responsibility to them and
to this country. Through no virtues and accomplishments of our own, we
have been fortunate enough to be born in the United States under the
most comfortable conditions. We, therefore, have a responsibility to
others who are less well off."
That
is what Robert Kennedy was given. What he leaves to us is what he said,
what he did, and what he stood for. A speech he made to the young
people of South Africa on their Day of Affirmation in 1966 sums it up
the best, and I would like to read it now:
"There
is discrimination in this world and slavery and slaughter and
starvation. Governments repress their people; millions are trapped in
poverty while the nation grows rich and wealth is lavished on armaments
everywhere. These are differing evils, but they are the common works of
man. They reflect the imperfection of human justice, the inadequacy of
human compassion, our lack of sensibility towards the suffering of our
fellows. But we can perhaps remember -- even if only for a time -- that
those who live with us are our brothers; that they share with us the
same short moment of life; that they seek -- as we do -- nothing but the
chance to live out their lives in purpose and happiness, winning what
satisfaction and fulfillment they can.
Surely,
this bond of common faith, this bond of common goal, can begin to teach
us som---ing. Surely, we can learn, at least, to look at those around

commodity than bravery in battle or great intelligence. Yet it is the

yields most painfully to change. And I believe that in this generation
those with the courage to enter the moral conflict will find themselves
with companions in every corner of the globe.
For
the fortunate among us, there is the temptation to follow the easy and
familiar paths of personal ambition and financial success so grandly
spread before those who enjoy the privilege of education. But that is
not the road history has marked out for us. Like it or not, we live in
times of danger and uncertainty. But they are also more open to the

That is the way he lived. That is what he leaves us.
My
brother need not be idealized, or enlarged in death beyond what he was
in life, to be remembered simply as a good and decent man, who saw wrong
and tried to right it, saw suffering and tried to heal it, saw war and
tried to stop it.
Those
of us who loved him and who take him to his rest today, pray that what
he was to us and what he wished for others will some day come to pass
for all the world.
As he said many times, in many parts of this nation, to those he touched and who sought to touch him:
"Some men see things as they are and say why. I dream things that never were and say why not."
